Terms of engagement

These terms apply to every engagement with One Man Marketing, run by Hasmukh Kalal. A signed quotation or proposal can add to them. Where the two differ, the quotation wins.

1. Scope and quotations

Work covers what the quotation or proposal lists, and nothing beyond it. Quotations are valid for 30 days. Anything outside the agreed scope is quoted separately before it starts.

2. Payments

• One time projects and setup fees are paid in advance, as stated in the quotation.
• Monthly fees are invoiced on the first of each month, in advance. Monthly engagements have a three month minimum.
• GST is not charged while One Man Marketing is below the registration threshold. This will be updated if that changes.

3. Third party costs

Ad spend, domains, hosting, software subscriptions and WhatsApp messaging charges are paid by you directly, or at cost where the quotation says so. Once bought, these costs are not refundable, because they are paid to other companies.

4. Refunds and cancellation

• Cancel within 48 hours of payment and before work starts: full refund, minus any third party costs already paid.
• Cancel after work starts but before the first draft is shared: 50% refund, minus third party costs.
• After the first draft is shared: no refund. You keep everything delivered up to that point.
• Monthly engagements can be ended with 30 days notice after the minimum period.

5. Revisions

Two rounds of revisions are included for each deliverable unless the quotation says otherwise. Further changes are quoted separately or covered by a maintenance plan.

6. Your part

Timelines depend on receiving content, access and approvals on time. Delays on your side move the timeline by the same amount. If a project gets no response for 45 days, it is closed and restarting it may be charged.

7. Results

Marketing results depend on your market, offer, pricing, budget, platforms and how your team handles leads. No specific number of leads, sales, rankings or return is guaranteed. What is promised is the agreed work, done properly, with honest reporting.

8. Ownership

Once paid in full, you own the website, pages, copy, creative and automations made for you. Ad accounts, CRM, domain and data are set up in your name from the start. Third party tools and licences remain under their own terms.

9. After launch

Bugs found within 15 days of a website or landing page going live are fixed free of charge. Later changes are covered by the optional maintenance plan or quoted separately.

10. Renewals

Domain, hosting and tool renewals are your responsibility. Reminders are sent ahead of known renewal dates, but a missed renewal is not the studio’s liability.

11. Portfolio and confidentiality

Work may be shown in the portfolio or case studies without confidential figures, unless you ask for it not to be. Your business information, data and numbers are kept confidential and never shared with anyone else.

12. Jurisdiction

These terms are governed by the laws of India. Any dispute falls under the jurisdiction of the courts in Mumbai, Maharashtra.
